Tracey Banks-Greczanik, with HappyHeartMCO, will be referred to as “Breeder” and the “Buyer” is referring to the person who has paid a deposit and/or final payment and agreed to these terms electronically. The Breeder and Buyer both agree to the following terms:
Cat or Kitten is being transferred to possession of the buyer as a pet only Maine Coon with no breeding rights.
Nonrefundable deposit of $500 to reserve cat/kitten which will be credited toward the purchase price. Purchase price includes full vaccinations according to the cat’s age, deworming, microchip and Pedigree. The total liability of the Breeder will not exceed the purchase price of the kitten,
Buyer understands the kitten will not be provided to the buyer until full funds have been received by Breeder, either via Zelle, cashiers check, cash, PayPal or Venmo unless otherwise agreed to by Buyer and Breeder.
Buyer understands the cost of transporting the cat/kitten is not included in the price and will be incurred at Buyer’s expense.
Transport of such cat/kitten will be arranged by Buyer in a means acceptable to Breeder and to be established prior to cat/kitten being given to Buyer
No cat/kitten is to be transported as cargo.
The Breeder guarantees that this kitten/cat is healthy at the time of purchase unless an ongoing medical condition is present and disclosed at the time of sale.
If such a condition is disclosed and the Buyer elects to take the kitten/cat while such condition is present, no further health guarantee is provided and the Breeder will accept no liability.
Should any undisclosed medical conditions be discovered within the first seven days of ownership or during the initial medical exam, the Breeder requests immediate notification.
The Breeder will not be liable for any medical costs associated with the kitten/cat that the buyer incurred.
Should the Buyer elect to keep the kitten/cat instead of returning it for a refund, the Buyer retains all liability for the medical costs of treating the condition.
Breeder also reserves the right to refuse the return of a sick or infectious cat until it is well again (with illness possibly incurred during the transportation of the cat to Buyer’s home).
Should the kitten/cat become sick or, God forbid, die due to a vet diagnosed congenital condition in the first FIVE years of the kitten/cat’s life, the Breeder will replace the kitten with one from a future litter of the Buyer’s choice. This kitten is to be chosen within one year after the originally purchased kitten/cat’s diagnosis.
Buyer understands that they are entrusted with an indoor only only pedigreed cat.
Buyer agrees that his cat will not be declawed nor mistreated under any circumstances, will not be allowed outdoors except in a carrier, on a lead or leash, or in a fully enclosed outdoor run or well-enclosed garden for their cat’s protection, safety and well-being.
Cat will be provided with adequate indoor facilities, proper nutrition and fresh water at all times.
Buyer will provide a cat tree or other climbing device, preferably with sisal rope for scratching.
Buyer will not leave this cat alone for more than 24 hours without making arrangements for a responsible person to provide fresh food, clean water and clean litter daily.
Buyer will keep this cat free of external and internal parasites such as fleas and worms.
Buyer will provide regular veterinary checks to ensure the good health condition of the cat and will provide treatment and care by a licensed veterinarian, if need be, no matter the financial cost.
Buyer will do everything possible to provide excellent care for this cat and provide a loving, safe and stress-free environment for this cat — respecting its own unique personality and needs.
Buyer agrees that this cat will never be given to a pet shop, research laboratory or similar facilities.
Breeder is transferring ownership of a “for pet only” cat whose physical attributes meet the standard for the Maine Coon breed. If, upon agreement between Breeder and Buyer, the kitten is not spayed/neutered prior to leaving, the Buyer agrees to NOT breed the kitten/cat.
If it, for some reason, becomes pregnant prior to spay or sires a litter prior to neuter, Buyer agrees to pay Breeder the cost of the kitten for breach of contract.
Buyer also agrees to return the kitten/cat to Breeder within 7 days of knowledge of pregnancy.
Breeder will withhold registration papers until evidence of spay/neuter is presented from licensed veterinarian.
The cat must be presented with his complete cattery name, this also includes online presence, HappyHeartMCO xxx.
If it becomes necessary for the Buyer to give up this cat, Buyer will contact the Breeder who has the first option to take back the cat at no charge (buyer will be expected to support transportation costs) or to assist the Buyer in finding another proper home for the cat.
If ownership of the cat changes with the breeder’s permission, the new adopter will be notified about the terms and conditions of this contract and will be expected to honor them.
Buyer will be alert for signs of illness in this cat, will consult their veterinarian and will not deny their cat any necessary care.
Breeder requires that the Buyer have their cat or kitten examined by a licensed veterinarian within 48 hours of arrival.
Buyer agrees to provide Breeder with regular updates (biannually, at a minimum) of the kitten in picture or video form, either as the Buyer sees fit or on request by Breeder.
Buyer agrees not to block Breeder from any social media and understands that, in doing so, would be a breach of this contract and therefore forfeits any rights to the kitten/cat.
Buyer understands and agrees that if any of the above terms and conditions shall be violated, the breeder reserves the right to reclaim immediate ownership of the cat and all it’s documents.
In such a case, the buyer will support all transportation costs involved for the cat to safely arrive back to the breeder’s home.
In case the buyer does not return the cat within a logical time frame, indicated by the breeder, the buyer will be obliged to compensate the breeder for the initial purchase price of the cat.
The Buyer should be aware that kittens often, during times of stress such as going to a new home, will exhibit temporary signs of illness including but not limited to sneezing, runny nose, watery eyes, diarrhea or constipation. Shipping by air or long car rides may also be stressful, especially if dry forced air circulation or excessive heat are involved. These effects can be minimized by feeding identical food as served by the Breeder, offering bottled or filtered water and by taking steps to reduce stress while introducing the kitten to the Buyer’s home and other pets. These symptoms are usually temporary and should go away within a few days if the kitten is not further stressed. 2.Breeder asks that this kitten be isolated from the Buyer’s other cats for aminimum of 7 days; preferably 21 days.
In case of any dispute between the Breeder and the Buyer, the parties will try to solve the dispute amicably.
Should these endeavors remain ineffective, the dispute will be solved by the Texas or US Federal public court, appropriate to the Breeder’s seat and the buyer will assume responsibility for all court costs.
By continuing with the electronic payment, parties consider this agreement to be legally binding.
